Copyright
All works presented on dziejma.art, including paintings, photographs, graphics, descriptive texts, video materials and the layout of the website, are the property of Magdalena Dziejma and are protected by copyright law (the Polish Act of 4 February 1994 on Copyright and Related Rights).
1. Prohibition of copying and use
Without the author’s written consent, it is prohibited to copy, save, print, reproduce, distribute, publish, modify or use in any form the content available on the website, whether for private or commercial purposes.
This prohibition covers in particular the creation of reproductions, printouts, prints, imprints on products and digital graphics, as well as commercial use in advertising and marketing materials.
2. Inspiration versus copying
Inspiration is a natural part of the creative process. However, it is not acceptable to imitate the composition, colour palette, characteristic motifs, style or layout of a painting in a way that may mislead viewers as to the authorship of the work or suggest that it was created by Magdalena Dziejma.
3. Buying an original and copyright
Buying an original painting does not mean that the copyright is transferred. The buyer receives only the physical work itself.
- The author retains all moral and economic rights.
- Without the author’s consent, it is not permitted to create reproductions or to use photographs of the painting for commercial purposes.
- Publishing photographs of the painting online (e.g. on Instagram) is permitted, provided the author is credited.
4. Licences and permissions
If a Customer or a company wishes to use photographs of paintings, graphics or content in publications, advertising materials, commercial products or media projects, written consent must be obtained and an appropriate licence agreement concluded.
5. Media publications
If you would like to publish photographs of the paintings in the press, online, on social media or in other materials, please contact me in advance to obtain consent and agree the terms of use.
6. Copyright infringement
If a copyright infringement is found (e.g. copying, selling reproductions, unauthorised prints), the author may demand:
- removal of the infringing content,
- cessation of the infringement,
- remedying of the effects of the infringement,
- remuneration or damages in accordance with the law.
